Terms of service
This Agreement enters into force upon its publication on the website.
This Public Offer Agreement (hereinafter referred to as the “Agreement” or the “Offer”) sets out the terms and conditions for purchasing goods from the svitlishe online store at https://svitlishe.com (hereinafter referred to as the “Website”).
1.1. Seller: Sole Proprietor Ovcharenko Marharyta Yuriivna, Taxpayer Registration Number 3484604220, email: hello@svitlishe.com (hereinafter referred to as the “Seller”).
1.2. This document constitutes the Seller’s public offer to enter into an electronic sale and purchase agreement in accordance with the Civil Code of Ukraine and the Laws of Ukraine “On Electronic Commerce” and “On Consumer Rights Protection.”
1.3. The Buyer accepts this Offer by placing an order on the Website and confirming it through the action provided in the checkout interface. Payment for an order also confirms acceptance of the Offer. Upon acceptance, an electronic agreement is concluded between the Seller and the Buyer under the terms of this Offer and the order placed.
1.4. The version of the Offer in effect when an order is placed applies to that order. The Seller may not unilaterally change the terms of an agreement that has already been concluded.
1.5. By placing an order, the Buyer confirms that they have the necessary legal capacity, have reviewed the product description, price, payment, delivery and return conditions, and have provided accurate contact details.
2.1. A Product is a finished ceramic item or another item presented on the Website with its description and price.
2.2. A Buyer is an individual or legal entity that places an order on the Website.
2.3. A Consumer is an individual who purchases a Product for personal needs unrelated to business activity or the performance of duties as an employee.
2.4. An Order is a properly submitted request on the Website to purchase a selected Product.
3.1. Svitlishe ceramic pieces are made and painted by hand. Unless otherwise stated in the product description, each piece is one of a kind.
3.2. The photographs, dimensions and description on a product page relate to the specific piece being offered. Before placing an order, the Buyer should review all available photographs and product details.
3.3. Minor variations in shape, signs of handcrafting, and differences in texture or glaze that are visible in the photographs or disclosed in the description and do not prevent the Product from being used safely for its intended purpose are features of handmade work rather than defects.
3.4. Nothing in this section limits the Buyer’s statutory rights if the Product has an undisclosed defect, is damaged or does not correspond to the order.
4.1. The Buyer independently selects a Product, adds it to the cart and provides the information required for payment and delivery.
4.2. Product information and availability are updated on the Website. Because most pieces are one of a kind, in the exceptional event that the same Product is purchased simultaneously by more than one Buyer, the Seller will notify the affected Buyer and refund the amount paid without delay.
5.1. The price of each Product is shown on its product page. The final order total, including delivery charges where delivery is paid during checkout, is displayed before the order is confirmed.
5.2. Payments are made in Ukrainian hryvnias. Other currencies may be displayed for reference; the amount actually charged may depend on the exchange rate and fees applied by the Buyer’s bank.
5.3. Bank card payments are processed through Hutko. The Seller does not receive the Buyer’s complete payment card details.
5.4. The Buyer receives proof of payment in the form required by law.
6.1. Orders are delivered within Ukraine and internationally by Nova Poshta.
6.2. The standard order processing time is 1–4 business days. Unless a different period is stated on the product page or agreed during checkout, the Product must be delivered to the Buyer no later than 30 days after the Agreement is concluded.
6.3. Upon receiving an order, the Buyer is advised to inspect the packaging and the Product at the carrier’s branch or in the courier’s presence. If the packaging or ceramic piece is damaged, the Buyer should, where possible, document the damage with the carrier’s representative and notify the Seller immediately. Failure to document the damage in this manner does not, by itself, deprive the Buyer of any statutory rights.
6.4. The risk of accidental damage to or loss of the Product passes to the Buyer once the Product has been physically received by the Buyer or by a person designated by the Buyer, except where otherwise provided by law.
7.1. A Consumer has the right to withdraw from a distance contract within 14 calendar days of receiving the Product, except where an exemption established by law applies.
7.2. To exercise the right of withdrawal, the Consumer must send an unambiguous statement to hello@svitlishe.com, specifying the order number and their contact details. Returning the Product itself within the prescribed period also constitutes termination of the Agreement.
7.3. A Product of satisfactory quality must remain in an unaltered condition. Opening the packaging and carrying out the inspection or examination necessary to assess the Product do not deprive the Consumer of the right to withdraw from the Agreement.
7.4. After receiving the withdrawal request, the Seller will provide return instructions and the return address. Expenses associated with returning a Product following withdrawal from a distance contract will be reimbursed by the Seller in accordance with Ukrainian law.
7.5. The Seller will refund the amount received for the Product without undue delay and no later than 30 days after being notified of the termination of the Agreement. The refund will be issued using the original payment method unless the Parties agree otherwise and another method is technically possible.
7.6. The right of withdrawal may not apply to a Product manufactured or modified specifically to the Buyer’s individual requirements if that Product cannot be sold to another person or could only be sold at a substantial financial loss to the Seller. This exemption does not apply merely because a finished piece is unique or handmade.
7.7. If the Buyer receives the wrong Product, a damaged Product or a Product with a defect that was not disclosed in its description, the Buyer should contact hello@svitlishe.com as soon as possible and, where possible, include photographs of the Product and its packaging. The Seller will review the claim and provide the remedies available to the Buyer under applicable law. Because each piece is unique, replacement with an identical Product may not be possible; this does not limit the Buyer’s right to a refund or any other remedy provided by law.
7.8. Detailed practical return procedures may be set out in a separate Return and Refund Policy. In the event of a conflict, the terms that do not restrict the Consumer’s statutory rights will apply.
8.1. The Seller must provide accurate and accessible information about the Product, its price, payment and delivery; supply the Product in accordance with the Order; properly handle the Buyer’s enquiries and claims; and comply with all other applicable legal requirements.
8.2. The Buyer must provide accurate information required to fulfil the Order, pay for and receive the Product under the agreed conditions, and use it in accordance with its intended purpose and care instructions.
8.3. The Parties have the other rights and obligations established by Ukrainian law and this Agreement.
9.1. The Parties are liable in accordance with Ukrainian law and this Agreement.
9.2. The Seller is not liable for failure to fulfil an Order caused by inaccurate or incomplete information provided by the Buyer, provided that the Seller has taken reasonable steps to clarify that information.
9.3. A Party is released from liability for a breach of its obligations if it proves that the breach resulted from force majeure. That Party must notify the other Party of the circumstances and their expected effect within a reasonable period.
9.4. Force majeure does not release the Seller from the obligation to refund payment for a Product that has not been and cannot be delivered to the Buyer.
10.1. The Seller processes the Buyer’s personal data to place, process payment for and deliver the Order, comply with legal requirements, and protect the legitimate rights of the Parties.
10.2. Detailed information about the types of data processed, legal grounds for processing, retention periods, recipients and the Buyer’s rights is provided in a separate Privacy Policy available on the Website.
10.3. Entering into this Agreement does not constitute the Buyer’s automatic consent to receive marketing communications. Such communications are sent only where there is a separate lawful basis, and the Buyer may unsubscribe from them.
11.1. The photographs, texts, illustrations, name, logo and other materials on the Website belong to the Seller or are used by the Seller on a lawful basis.
11.2. Purchasing a Product does not transfer intellectual property rights in its design, images or other materials to the Buyer unless the Parties separately agree otherwise in writing.
12.1. The Agreement relating to a particular Order remains in effect from the moment of acceptance until both Parties have fully performed their obligations.
12.2. The Seller may update the Offer for future Orders. A revised version enters into force on the date it is published on the Website or on a later date specified in that version.
12.3. The Parties will attempt to resolve any dispute through negotiation. The Buyer may submit a claim by writing to hello@svitlishe.com or to the Seller’s address.
12.4. If a dispute cannot be resolved through negotiation, it will be handled in accordance with Ukrainian law. This Agreement does not restrict the Consumer’s right to apply to a competent authority or court.
